Acceptance of Terms
By accessing or using Vyds ("the Service"), operated by Vyds ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to the web application at vyds.io, the desktop applications for macOS and Windows, and the Chrome browser extension.
Description of Service
Vyds is a screen recording platform that allows you to record your screen, webcam, and audio, edit recordings, and share them via links. The Service includes a Chrome browser extension, desktop applications for macOS and Windows, a web-based video player and editor, and team collaboration features. We may update, modify, or discontinue features of the Service at any time.
User Accounts
You must create an account to use most features of the Service. You authenticate through Google OAuth and are responsible for maintaining the security of your account. You must provide accurate information and keep your account details up to date. You are responsible for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized access to your account.
Acceptable Use
You agree not to use the Service to:
- Upload, share, or distribute illegal, harmful, or objectionable content
- Infringe on the intellectual property rights of others
- Record individuals without their consent where required by applicable law
- Attempt to gain unauthorized access to the Service, other accounts, or related systems
- Use the Service for spam, phishing, or distributing malware
- Interfere with or disrupt the integrity or performance of the Service
- Use automated means to access the Service except through our published APIs
- Resell or redistribute the Service without our written permission
We reserve the right to suspend or terminate accounts that violate these terms.
Intellectual Property
Your content: You retain all ownership rights to recordings and content you create using the Service. By uploading content to Vyds, you grant us a limited license to store, process, and deliver your content as necessary to provide the Service. We do not claim ownership of your recordings.
Our service: The Service, including its design, features, code, and documentation, is owned by Vyds and protected by intellectual property laws. You may not copy, modify, or reverse-engineer any part of the Service.
Payment and Billing
Vyds offers a free tier and paid subscription plans. All payments are processed through Stripe. Paid plans are billed on a recurring basis (monthly or annually) and automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you retain access to paid features until then. Limitation of Liability
To the maximum extent permitted by applicable law, Vyds shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
Termination
You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your account if you violate these Terms or if we reasonably believe your use of the Service poses a risk to us, other users, or third parties. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination to allow you to export your recordings, after which it will be permanently deleted.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. If we make significant changes, we will notify you via email or through the Service. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.
